Privacy Policy

Jose Camacho Sanchez (NIF 47665733G, Calle Teodoro Perianes 24, 10430 Cuacos de Yuste (Cáceres), Spain; "we," "us," or "our") operates the TCG AI Pro mobile application and the website https://tcgai.pro (collectively, the "Service") and is the controller of your personal data under the EU General Data Protection Regulation (GDPR). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service.

By using TCG AI Pro, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Service.

1. Information We Collect

1.1 Personal Information You Provide

  • Account Data: When you register, we collect your name, email address, and display name.
  • Profile Information: You may optionally provide a profile photo (avatar) and bio.
  • Card Images: When you use our pre-grading service, you upload photographs of trading cards (front and back). These images are transmitted to our servers and to AI processing providers we use to generate the TCGAI Score. Images and the resulting TCGAI Score data are stored to generate, display and maintain your TCGAI certificate page and your collection.
  • Consent Audit Records: When you accept our Terms of Service, Privacy Policy and AI Disclaimer, we record an audit row containing your account ID (or, for guests, an anonymous session token), the document versions you accepted, the timestamp, your IP address, your User-Agent and your locale. We keep this record for as long as you use the Service in order to be able to demonstrate, if required, that consent was given for the version applicable at the time.
  • Community Content: Comments, reactions, and posts you make in the community feed.
  • Payment Information: Subscriptions bought in the app are processed by Google Play; subscriptions bought on the website are processed by Stripe. We do not collect or store your full card number, bank account details or other financial information. We receive your billing details, a transaction confirmation and the subscription status from Google Play or Stripe.

1.2 Information Collected Automatically

  • Device Information: Device type, operating system version, and unique device identifiers.
  • Usage Data: How you interact with the app, including features used, grading history, and session duration.
  • Log Data: IP address, access times, and error logs for troubleshooting purposes.

1.3 Local Storage

We use local storage technologies (SharedPreferences) on your device to keep you signed in, store your privacy consent preference, and remember app settings. This data stays on your device and is not transmitted to our servers unless necessary for authentication.

2. How We Use Your Information

We use the information we collect to:

  • Provide the Service: Process your card images through our AI grading system and generate digital grading certificates.
  • Manage Your Account: Create and maintain your user account, authenticate your identity, and manage your subscription.
  • Improve the Service: Analyze anonymous usage patterns to improve app performance, AI accuracy, and user experience.
  • Community Features: Display your graded cards, comments, and reactions in the community feed if your profile is set to public.
  • Communications: Send you service-related notifications, updates, and support responses.
  • Security: Detect and prevent fraud, abuse, and unauthorized access.

3. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties for advertising or marketing purposes.

We may share your information only in the following circumstances:

  • Community Features: If your profile is set to public, your display name, avatar, graded cards, and community activity (comments, reactions) are visible to other users.
  • Service Providers: We may share data with trusted third-party providers who assist us in operating the Service (e.g., hosting, analytics), subject to confidentiality agreements.
  • Legal Requirements: We may disclose your information if required to do so by law, regulation, legal process, or governmental request.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

4. Data Storage and Security

Your data is stored on secure servers. Card images and grading data are stored to generate and maintain your digital certificates. We implement industry-standard security measures including:

  • HTTPS/TLS encryption for all data in transit
  • Secure server infrastructure
  • Access controls limiting who can view your data
  • Regular security reviews

While we strive to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.

5. Data Retention

  • Account Data: Retained as long as your account is active.
  • Card Images & Certificates: Retained as long as your account is active to provide ongoing access to your grading history and certificates.
  • Usage Analytics: Aggregated, anonymized data may be retained indefinitely for service improvement.

Upon account deletion, your personal data will be removed within 30 days, except where retention is required by law.

6. Your Rights and Choices

Depending on your jurisdiction, you may have the following rights:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate personal data.
  • Deletion: Request deletion of your personal data and account.
  • Data Portability: Request your data in a machine-readable format.
  • Withdraw Consent: Withdraw your consent at any time (this does not affect the lawfulness of processing before withdrawal).
  • Opt-Out: You can set your profile to private to prevent your cards from appearing in the community feed.

7. Children's Privacy

TCG AI Pro is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at [email protected], and we will take steps to delete such information.

Our Service may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing any personal information.

We will notify you of any material changes by posting the new Privacy Policy within the app or on our website and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised policy.
