Terms of Service

Welcome to TCG AI Pro. These Terms of Service (“Terms”) govern your access to and use of the TCG AI Pro mobile application and website at https://tcgai.pro (collectively, the “Service”), operated by WHITE HAT MGMT L.L.C. (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

TCG AI Pro is an AI-powered trading card grading platform that allows users to:

• Upload photographs of trading cards for automated AI grading analysis
• Receive digital grading certificates with sub-grade scores (Centering, Corners, Edges, Surface)
• Manage a collection of graded cards
• Participate in a community feed to share, comment on, and react to graded cards
• Access market price estimates for graded cards

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account and use the Service. By creating an account, you represent that you meet this age requirement.

3. Subscription Plans and Payments

3.1 Free and Paid Plans

TCG AI Pro offers a free tier with limited features and paid subscription plans (“Normal” and “Pro”) with additional features and higher usage limits. Details of each plan’s features and pricing are displayed within the app.

3.2 Billing

All subscription purchases are processed through Google Play. By purchasing a subscription, you agree to Google Play’s Terms of Service and payment terms. We do not directly process or store your payment information.

3.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. You will be charged through your Google Play account.

3.4 Cancellation

You may cancel your subscription at any time through your Google Play subscription settings. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refund will be issued for the remaining time in the current billing period
• Your account will revert to the free tier after the billing period expires

3.5 Refunds

Refund requests are handled in accordance with Google Play’s refund policies. To request a refund, please contact Google Play Support or visit your Google Play subscriptions.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload images that are not trading cards or that contain inappropriate, offensive, illegal, or copyrighted content that you do not have the right to use
• Use the Service for any fraudulent or deceptive purpose, including misrepresenting AI grades as official grades from professional grading companies (PSA, BGS, CGC, etc.)
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems
• Use automated systems, bots, or scripts to access the Service without our written permission
• Harass, abuse, threaten, or intimidate other users through comments, messages, or community features
• Post spam, advertisements, or solicitations in the community feed
• Violate any applicable local, state, national, or international law or regulation

5. AI Grading Disclaimer

IMPORTANT: TCG AI Pro provides AI-generated grading assessments for informational and entertainment purposes only. Our AI grades are:

• Not official grades. They are not equivalent to, or a replacement for, professional grading from companies such as PSA, BGS, CGC, or SGC.
• Estimates only. AI analysis may not account for all factors that professional graders consider (e.g., print defects, surface texture under magnification, authentication).
• Not guarantees of card value. Market prices and grade estimates are approximations and should not be relied upon as financial advice or appraisals.

You acknowledge and agree that you use AI grading results at your own risk and that we shall not be held liable for any decisions made based on our grading assessments.

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, code, AI models, grading algorithms, and all associated intellectual property, is owned by WHITE HAT MGMT L.L.C. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

6.2 Your Content

You retain ownership of the card images and content you upload. By uploading images to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and display your images for the purpose of:

• Providing the grading service and generating certificates
• Displaying in your collection and, if your profile is public, in the community feed
• Improving our AI models and service quality (using anonymized data)

You represent and warrant that you have the right to upload all content you submit and that such content does not infringe on the rights of any third party.

6.3 Trading Card Trademarks

All trading card game names, logos, and related trademarks (including but not limited to Pokémon, Magic: The Gathering, Yu-Gi-Oh!, etc.) are the property of their respective owners. TCG AI Pro is not affiliated with, endorsed by, or sponsored by any trading card game publisher or professional grading company.

7. Community Guidelines

When using community features (feed, comments, reactions), you agree to:

• Be respectful of other users
• Not post offensive, hateful, discriminatory, or inappropriate content
• Not impersonate other users or entities
• Report violations to us at [email protected]

We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Upon your request

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive (including, without limitation, intellectual property provisions, disclaimers, and limitation of liability).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI grading results will be accurate, complete, or consistent with professional grading
• Any defects in the Service will be corrected
• Market price estimates reflect actual market values

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHITE HAT MGMT L.L.C. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless WHITE HAT MGMT L.L.C. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any rights of any third party
• Any content you upload to the Service

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in New Brunswick, New Jersey, in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction in Middlesex County, New Jersey.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or on our website and updating the “Last Updated” date. Your continued use of the Service after revised Terms are posted constitutes your acceptance of those changes.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WHITE HAT MGMT L.L.C. regarding the Service and supersede all prior agreements and understandings.
